Disclaimer

Summit Zero is provided “as is”. Summit Zero and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Summit Zero, nor its suppliers and licensors, makes any warranty that the Summit Zero website or its subscriptions will function or be error-free or that access thereto will be continuous or uninterrupted. Your use of Summit Zero is completely at your own risk.

Limitation of Liability

In no event will Summit Zero, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for:

  • any special, incidental or consequential damages
  • the cost of procurement for substitute products or services
  • interruption of use or loss or corruption of data
  • for any amounts that exceed the fees paid by you to Summit Zero under this agreement during the twelve (12) month period prior to the cause of action

Summit Zero shall bear no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

Subscribers

By subscribing to Summit Zero, or by accessing or using the Summit Zero website, you agree to be legally bound by these Terms. You must provide your real name, a valid email address, the subscriber’s company and any other information we require when you subscribe or register. If you are subscribing or registering on behalf of a company, you represent that you have the authority to represent the company, its affiliates, and all users who access Summit Zero services through your account, all of whom will be bound by these Terms. The term “subscriber” includes both the individual user who subscribes or registers on his or her own behalf and the individual who subscribes or registers on behalf of a company. It also includes the company that an individual subscriber represents and enrolls as a subscriber.

Authorized Users

Access to Summit Zero services is limited to subscribers and authorized users only. An “authorized user” is an individual who:

  • is designated by the subscriber as an authorized user
  • is employed by a subscriber or engaged as independent contractor of a subscriber
  • agrees to be bound by all of these terms and conditions to the same extent that the subscriber is bound.

By accessing or using the Summit Zero website and its services, you represent and warrant that you are a subscriber or an authorized user and that you are at least 18 years old.

User Names and Passwords

Subscribers and authorized users may access the data from any web browser by entering an approved username and the correct password. You are responsible for maintaining the confidentiality your account and password. Each username may only be used by one person. You may not share a username with anyone else.

Account and Billing

Signing up for Summit Zero’s subscription services (including ElitePRO status) will require you to provide credit card details. You will be billed on the date that you subscribe to our service, and thereafter in advance on a monthly basis. We will automatically bill your credit card each month on the calendar day corresponding to the commencement of your subscription. In the event your upgrade began on a day not contained in a given month or year, we will bill your credit card on the last day of such month or year. For example, if your upgrade began on January 31st, February 28th is the next time your credit card would be billed.

If any fee is not paid in a timely manner, or we are unable to process your transaction using the credit card information provided, we reserve the right to suspend or cancel your account.

If you wish to use a different credit card or if there is a change in your credit card validity or expiration date, you may edit your information by accessing your “Subscription” page. If your credit card reaches its expiration date, your continued use of the Summit Zero service constitutes your authorization for us to continue billing that credit card and you remain responsible for any uncollected amounts. It is your responsibility to keep your contact information and payment information current and updated.

Changes to Service and Pricing

We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, Summit Zero’s subscription services (including ElitePRO) with or without notice.

Pricing — including but not limited to monthly subscription fees to the ElitePRO service — are subject to change upon 30 days notice from us. Such notice may be provided at any time by email and posted on our website.

Summit Zero shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Support

Technical support is available to Summit Zero subscribers. To reach our customer support services, contact us by e-mail. A valid and current subscription is required for support. We provide support Monday through Friday, 9 a.m. to 5 p.m. EST (but not on national holidays) and try our best to respond within one business day.

You acknowledge that we may not be able to resolve every technical support request, and that any support we provide is on a “best efforts” basis only.

Downgrading your Account

You can downgrade your subscription at any point by contacting us directly. Downgrading your account may cause the loss of features and support; Summit Zero does not accept any liability for such loss. All payments are non-refundable. There will be no refunds or credits for partial months of service, or downgrade refunds. In order to treat everyone equally, no exceptions will be made.

Cancellation and Termination

Only the subscriber may cancel the subscription before it expires. Authorized users may not cancel a subscriber’s subscription.

Your Account will continue in effect unless and until you cancel your account or we terminate it.

You can cancel your account at any time by following this link and turning off “auto-renew”.

All of your site information will be immediately deleted from the Service upon cancellation. This information can not be recovered once your account is canceled.

If you cancel the account before the end of your current paid-up month, your cancellation will take effect immediately and you will not be charged again. There will be no refunds or credits for partial months of service.

Summit Zero, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your account or access to your account, and the forfeiture and relinquishment of all site information in your account. Summit Zero reserves the right to refuse service to anyone for any reason at any time.

By signing up for a Summit Zero account and by providing Summit Zero with your payment account information, you hereby agree to these payment terms and conditions.
